Position Zero Direct Answer: How is RERA Delay Interest Calculated?
Under Section 18 of the RERA Act, 2016, builder delay interest is calculated as simple interest at SBI's Highest MCLR plus 2% per annum on actual payments made by the buyer. If staying in the project, the builder must pay interest for every month of delay from the promised possession date. If withdrawing, the builder must refund the entire principal plus interest from each payment date.
How RERA Builder Delay Interest is Calculated (Section 18 Rules)
Governed by Section 18(1) of RERA 2016 and state RERA rules.
If the homebuyer chooses to retain the flat until completion, the promoter must pay monthly interest from the promised possession date:
Calculated for every calendar month until the promoter issues a valid Occupancy Certificate (OC) and Offer of Possession.
If the homebuyer chooses to withdraw from the project due to inordinate delay, simple interest runs on each milestone installment:
Total Refund Order = All Paid Installments + Total Accumulated Interest from respective dates of deposit.

Frequently Asked Questions (RERA Section 18 Delay Interest)
Authoritative answers on RERA legal claims, Builder-Buyer Agreements, and court enforcement.
Can the builder pay only ₹5 per sq. ft. as mentioned in the Builder-Buyer Agreement?
No. In landmark rulings (including Pioneer Urban Land & Infrastructure Ltd. vs Govindan Raghavan and Imperia Structures vs Anil Patni), the Supreme Court of India held that one-sided penalty clauses (such as ₹5/sq. ft./month) in pre-printed builder contracts constitute unfair trade practices. Section 18 of RERA overrides such clauses, entitling buyers to the statutory rate (SBI Highest MCLR + 2%).
Does a buyer lose rights under Section 18 by accepting delayed possession?
No. Accepting physical handover or taking keys to the apartment does not extinguish your legal entitlement to delay compensation. Buyers are entitled to claim interest for the entire intervening delayed period from the committed possession date up to the date of handover.
How does the RERA authority enforce refund orders if the builder defaults?
If a promoter fails to comply with a RERA refund or compensation order, Section 40 of RERA provides that the amount shall be recovered as arrears of land revenue. The authority issues a Revenue Recovery Certificate (RRC) to the District Collector/Magistrate, who has the power to attach the promoter's bank accounts, seize project assets, or auction unsold inventory to satisfy the decree.
Is RERA delay interest taxable in the hands of the homebuyer?
Under the Income Tax Act, interest received as compensation for delayed possession under Section 18 is generally classified as "Income from Other Sources" and taxed at the individual's applicable slab rate. Promoters typically deduct 10% TDS under Section 194A when releasing interest payments.
