What is the EPS 95 Higher Pension Option?

EPS 95 Higher Pension is a statutory retirement provision validated by the Supreme Court of India in November 2022 (EPFO v. Sunil Kumar). It allows eligible organized-sector employees to compute their monthly pension using their actual 60-month average basic salary + DA under the formula (Pensionable Salary × Service) ÷ 70, rather than being restricted to the statutory wage ceiling of ₹15,000 per month (which hard-caps regular pension at ₹7,500/month).

How the Calculation Works (Official EPFO Guidelines)

Standard Capped Pension Formula

For members contributing strictly under the statutory ceiling, pensionable salary is capped at ₹15,000/month (or ₹6,500 prior to 1st September 2014):

Standard Pension = (₹15,000 × Effective Service) ÷ 70

Maximum possible pension under 35 years service is flat ₹7,500 per month.

Higher Pension on Actual Salary Formula

For members exercising the joint option under Paragraph 11(3) / 11(4), pensionable salary is the true uncapped average basic pay:

Higher Pension = (60-Mo Average Basic Pay × Effective Service) ÷ 70

Subject to an additional 1.16% employer contribution diversion on wages exceeding ₹15,000.

The 2-Year Bonus Weightage Rule (Para 10(2))

If an employee completes 20 or more years of pensionable service, EPFO statutorily adds 2 bonus years to the service calculation, capped at a maximum of 35 years. For instance, 25 years becomes 27 years, and 33 years becomes the maximum 35 years.

Frequently Asked Questions (EPS 95 Higher Pension)
How is EPS 95 Higher Pension calculated on actual salary?▾

Higher Pension is calculated under Paragraph 12 of the Employees' Pension Scheme, 1995 using the statutory formula: Monthly Pension = (Pensionable Salary × Pensionable Service) ÷ 70. Following the Supreme Court ruling dated November 4, 2022, Pensionable Salary for members who opted for higher pension is the average monthly basic pay plus DA drawn over the last 60 months of service, completely removing the statutory ₹15,000 wage ceiling.

What is the 2-year bonus weightage rule under EPS 95?▾

Under Paragraph 10(2) of the EPS 1995 Scheme, employees who complete 20 or more years of pensionable service (or retire upon reaching age 58 with 20+ years service) are granted an additional 2 bonus years added to their qualifying service, subject to a statutory maximum cap of 35 service years. For example, an employee with 28 years service gets credited with 30 years in the pension formula.

How does EPFO determine the past arrears transfer from EPF to EPS?▾

To fund the higher monthly pension, the differential 8.33% employer contribution on basic salary above the statutory ceiling (₹6,500 pre-September 2014 and ₹15,000 post-September 2014), along with an additional 1.16% contribution on salary exceeding ₹15,000, is transferred from the member's accumulated EPF corpus to the Pension Fund. This transfer amount is compounded with the historical annual interest rates declared by EPFO (~8.25% p.a.).

How long does it take to recover the EPF arrears transfer (Breakeven)?▾

For most corporate and PSU employees, the breakeven period ranges between 4.5 and 8.5 years of monthly pension payouts. Because the monthly pension increase is substantial (often 4x to 7x higher than the standard ₹6,000–₹7,500 cap), retirees who survive past the breakeven age enjoy an exponential net financial surplus for the rest of their lives, guaranteed by the Government of India.

What happens to EPS pension in case of early retirement before age 58?▾

Under Paragraph 12(7) of EPS 95, a member can commence early pension between ages 50 and 57 provided they have completed at least 10 years of qualifying service. However, early pension is subject to a strict permanent penalty of 4% per year for each year before age 58. For instance, commencing pension at age 55 incurs a permanent 12% deduction (3 years × 4%). Conversely, deferring pension up to age 60 grants a 4% bonus per year delayed.
